Priest Jailed For Defiling Girl At The Alter
A man of the cloak in Tran Nzoia County has been found guilty of attempted defilement of a girl in the alter and sent behind bars for five years. The man identified as father Bernard Magina who was serving at Kipsaina Catholic church was charged with attempting to defile a minor if 11 years. Thus is alleged to have occurred in Kipsaina shopping center in Trans Nzoia County.
The father who us 45 years of age was lucky to gave acquittal in the second count of committing an indecent act with a minor but the main count got him awardee five yeas behind bars. The senior resident magistrate making his ruling noted that the prosecution had proven their case beyond any reasonable doubt hence finding the accused guilty of the first count. “I FIND THAT THE PROSECUTION HAS PROVED THEIR CASE AGAINST THE ACCUSED PERSON BEYOND ANY REASONABLE DOUBT. I, THEREFORE, CONVICT HIM TO FIVE YEARS IMPRISONMENT WITH 14 DAYS RIGHT OF APPEAL,” the magistrate said.
The prosecution having five witness to testify against the accused but the accused did not gave any witness. Upon the charges being read to the priest, he had entered a plea of not guilty for the count of attempting to defile a minor.
The details show that the father had attempted the act at the back if his car which was in the church compound. The mother to the minor stares that when her daughter took too long to return home from church, she sent her siblings to look for her. When the search extended to the church us when the girl was discovered inside the car belonging to the priest.
The mother said she had to alert people by screaming and after reported the matter to the police station. “I THEN SENT HER SIBLINGS TO GO AND LOOK FOR HER BUT SHE COULD NOT BE FOUND. IT IS WHEN I WENT TO LOOK FOR HER AT THE CHURCH ONLY TO FIND HER INSIDE THE PRIEST’S VEHICLE THAT WAS PARKED OUTSIDE THE CHURCH COMPOUND,”she said .
